Import Alert 99-05 Detention without Physical Examination (DWPE)
Applicable for all raw agricultural commodities.
FDA has the authority to place any container in detention when it arrives to the USA if there is a reason to believe that the product has chemical residuals that exceed the allowed limits in the USA. MRLs.
This type of detention is issued without any examination to the product, the exporter/importer must proof FDA that the product doesn’t have chemical residuals and is in compliance with the USA MRLs.
Once FDA has placed a detention/On-Hold a load, all of the continuing loads from the same label/shipper/packer/grower will be detained by default for the rest of the season, unless you proceed with a formal process to remove your company from this detention without physical examination (DWPE) list AKA red list.
Containers placed on FDA detention can be detained for up to 2 or 3 if the exporter/importer does not react on time with what needs to be done.
